Partner

Fernando is one of the partners who leads Litigation and Arbitration area. He is also in charge of the Insolvency and Restructuring Area. He has 30 years of professional experience mainly developed in advising and representing different clients in civil lawsuits, arbitration and administrative proceedings. Additionally, he has an active practice in bankruptcy law. He has been a member of the arbitration board of the Arbitration and Mediation Center of the Santiago Chamber of Commerce since 2014.

Experience

Fernando joined our firm in 2001 and has been a partner since 2009. He has vast experience in domestic and international litigation and arbitration. He is in charge of litigation area and has participated in diverse matters such as: concessions, mining, corporate conflicts, indemnifications and contractual conflicts, among others. Additionally, he has participated in several bankruptcy reorganization processes. He has advised clients who are involved in diverse activities such as mining, energy, real estate, technology, retail, services, concessions, fuel distribution, investment companies, health, forestry, telecommunications, food processing and distribution, among others.

He has been appointed sole arbitrator and chairman of arbitration panels in several commercial and construction arbitrations at the Arbitration and Mediation Center of the Santiago Chamber of Commerce.

Relevant Transactions / Milestones / Cases

  • Advice and representation of concessionaire company in claims before conciliation and arbitration commissions in conflicts with the Ministerio de Obras Públicas.
  • Advice and representation of electric company in several arbitration and litigation proceedings, due to conflict with minority shareholder.
  • Advice and representation of a health services provider in a conflict with a construction company arising from the construction of a relevant work.
  • Advice and representation of health care provider in medical liability lawsuits.
  • Advice and representation of a fuel distribution company in several arbitrations and litigations related to real estate and the operation of service stations and convenience stores.
  • Advising and representing a health care provider in reorganization proceedings and administrative proceedings before the Superintendence of Health.
  • Advice and representation of a multinational client in the manufacturing, rental and repair of equipment for mining activities, in its capacity as creditor in several reorganization and liquidation bankruptcy proceedings.
